1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "Customer") and Sleeping Baby Guide ("we", "us", or "our"), operated by Jamie Sharify, based in British Columbia, Canada. By accessing our website at www.sleepingbabyguide.com or purchasing any of our digital products, you agree to be bound by these Terms in full. If you do not agree, please do not use our website or purchase our products.

These Terms apply to all visitors, users, and customers regardless of whether you are located in Canada, the United States, or elsewhere.

2. Products and Digital Goods

Sleeping Baby Guide sells downloadable PDF sleep guides ("Guides") for parents and caregivers of infants and toddlers. All Guides are delivered electronically as digital files. No physical product is shipped.

Upon completing a purchase, you will receive an email containing a secure, time-limited download link for your Guide(s). You are responsible for downloading and saving your Guide promptly. Download links expire after a reasonable period; if your link has expired, please contact us at [email protected] and we will issue a new link at no charge.

All prices are displayed and charged in United States Dollars (USD) unless otherwise stated. Applicable taxes may be added at checkout depending on your location.

3. Licence to Use

Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable licence to download, view, and use the Guide for your own personal, non-commercial purposes only. You may print one copy for personal use.

You may not:

  • Reproduce, copy, redistribute, or resell any Guide in whole or in part.
  • Share your download link or the Guide file with any other person.
  • Use any Guide for commercial purposes, including in a professional sleep consulting practice, without our prior written consent.
  • Remove or alter any copyright, trademark, or proprietary notices contained in the Guide.
  • Upload any Guide to any file-sharing platform, website, or social media.

All Guides are protected by Canadian copyright law (Copyright Act, R.S.C. 1985, c. C-42) and United States copyright law (17 U.S.C.). Unauthorised reproduction or distribution may result in civil and criminal penalties.

4. Refund and Return Policy

Because our Guides are digital products delivered immediately upon purchase, all sales are generally final. However, we offer a 30-day satisfaction guarantee: if you are not satisfied with your Guide for any reason, contact us within 30 days of purchase at [email protected] and we will issue a full refund, no questions asked.

Refunds are processed to the original payment method within 5 to 10 business days. Once a refund is issued, your licence to use the Guide is revoked and you must delete all copies.

Canadian customers: Under the British Columbia Business Practices and Consumer Protection Act (BPCPA) and similar provincial consumer protection legislation, you have statutory rights that may apply to digital goods. Our 30-day guarantee meets or exceeds these statutory requirements.

US customers: Refund rights for digital goods vary by state. Our 30-day guarantee is offered voluntarily and does not limit any statutory rights you may have under applicable state consumer protection law.

5. Medical and Professional Disclaimer

The content in our Guides and on our website is provided for general informational and educational purposes only. It is not intended to be, and does not constitute, medical advice, diagnosis, or treatment. The information is based on publicly available sleep research and general parenting guidance.

Always consult a qualified healthcare professional, paediatrician, or registered sleep consultant before making changes to your child's sleep routine, particularly if your child has any medical condition, developmental concern, or health history that may affect sleep. 6. Limitation of Liability

To the maximum extent permitted by applicable law, Sleeping Baby Guide, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or Guides, including but not limited to loss of data, loss of profits, or personal injury.

Canadian customers: Nothing in these Terms limits or excludes any liability that cannot be excluded under applicable Canadian federal or provincial law, including liability for fraud, death, or personal injury caused by negligence.

US customers: Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such states, our liability is limited to the fullest extent permitted by law.

7. Disclaimer of Warranties

Our website and Guides are provided on an "as is" and "as available" basis without any representation or warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We operate an affiliate programme that allows approved participants to earn commissions by referring customers. Affiliates are independent contractors, not employees or agents of Sleeping Baby Guide. Affiliates are responsible for complying with all applicable laws when promoting our products, including the US Federal Trade Commission (FTC) disclosure requirements (16 C.F.R. We reserve the right to approve, reject, or terminate affiliate applications at our sole discretion. Commission rates and programme terms are subject to change with reasonable notice.

By providing your email address and completing a purchase or free guide request, you consent to receive transactional emails related to your order, including your receipt, download link, and post-purchase support emails.

If you opt in to our newsletter, you consent to receive marketing emails from us. You may withdraw this consent and unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting us directly.

Our email practices comply with Canada's Anti-Spam Legislation (CASL) (S.C. 2010, c. 23) and the United States CAN-SPAM Act (15 U.S.C. 7701 et seq.). Each marketing email we send includes our business name, a valid mailing address, and a clear unsubscribe mechanism.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your purchase shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in British Columbia, Canada, in accordance with the British Columbia Arbitration Act (S.B.C. 2020, c. 2), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

US customers: If you are a US consumer, you may also have the right to bring a claim in small claims court in your jurisdiction. Nothing in this clause limits any statutory rights you may have under applicable US federal or state consumer protection law that cannot be waived by contract.

Class action waiver: To the extent permitted by applicable law, you agree to resolve any dispute on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sleeping Baby Guide, its owner, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of our website or Guides; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
